FareLedger Terms of Use

Last updated: [DATE]
These terms are an agreement between you and Melanie Antonia Marin Munoz, a sole trader trading as FareLedger (ABN 47 896 798 800), New South Wales, Australia ("FareLedger", "we", "us"). They apply when you use the FareLedger app or website. By creating an account or using FareLedger, you agree to these terms and to our Privacy Policy.
Please read them. If you don't agree, don't use FareLedger.
1. What FareLedger is
FareLedger helps rideshare drivers in Australia keep their tax records. It lets you:
- add your Uber and DiDi statements, expenses, receipts and things you buy for work;
- keep a car logbook with shifts and odometer readings;
- see estimates of your income, deductions, GST and BAS figures, and your car claim; and
- export your records for your accountant.
FareLedger is not affiliated with, endorsed by or connected to Uber, DiDi, the Australian Taxation Office (ATO) or any government agency. Uber and DiDi are trademarks of their owners.
2. FareLedger is not tax advice
- FareLedger gives estimates and general information, based on the records you add and on general ATO rules. It does not give tax, financial, accounting or legal advice, and it doesn't consider your personal circumstances.
- FareLedger does not lodge anything with the ATO and does not act for you with the ATO.
- You are responsible for your tax affairs: checking every figure before you use it, keeping your records, and lodging your BAS and tax return correctly and on time, yourself or through a registered tax or BAS agent.
- Statements, receipts, spreadsheets and photos you upload are read by AI. AI can make mistakes. The app asks you to check what it read before saving; please do.
- Tax rules and rates change. We try to keep FareLedger up to date, but we can't promise it always reflects the latest law.
For advice about your own situation, talk to a registered tax agent.
3. Who can use FareLedger
- You must be 18 or older.
- FareLedger is designed for people who drive for rideshare platforms in Australia.
- You must give accurate information when you create your account and keep it up to date.
4. Your account
- You can sign up with your email and a password, or with Google or Apple.
- Keep your sign-in details private. You're responsible for what happens in your account. Tell us straight away at support@fareledger.com.au if you think someone else has used it.
- One account is for one person.
5. Your records belong to you
- You own the information and files you add to FareLedger (your records).
- You give us permission to store, copy, process and display your records only to run FareLedger for you: for example, to read your statements, work out your figures and create your exports. This includes sending files to the service providers listed in our Privacy Policy, such as the AI service that reads your uploads.
- We don't sell your records or use them for advertising.
- Only upload files and information you're allowed to use. Never enter your Tax File Number (TFN).
- Keep your own copies. The ATO generally expects records to be kept for 5 years after you lodge. Download your export (Reports → Export) regularly, and before you delete your account.
6. Using FareLedger properly
You agree not to:
- break the law, or use FareLedger to deceive anyone, including the ATO;
- upload anything harmful (such as viruses) or anything you don't have the right to use;
- try to access other people's accounts or records, or get around the app's security;
- copy, resell, reverse-engineer or overload FareLedger, or use automated tools to scrape it; or
- use FareLedger in a way that could harm us, other users or our service providers.
7. Prices, free trial and subscriptions
- Free trial: new accounts get a free trial of [30] days. You won't be charged during the trial.
- Price: after the trial, FareLedger costs $[9.99] a month or $[89.99] a year, including GST.
- Paying: you subscribe in the iPhone or Android app. Apple or Google handle the payment and keep your card details; we never see them. Their terms also apply to billing, renewals, cancellations and refunds.
- Renewing: when the trial ends, your subscription starts automatically and then renews every month or year until you cancel. To avoid being charged, cancel in your Apple or Google account settings at least 24 hours before the trial or the current period ends. Deleting the app does not cancel your subscription.
- One subscription, every device: your subscription also lets you use the FareLedger web app with the same account, at no extra cost.
- If we change our prices, we'll tell you at least 30 days before the new price applies to you, and you can cancel before then.
- Nothing in these terms limits your rights to a refund under the Australian Consumer Law.
8. Changes and availability
- We keep improving FareLedger, so features may change. If we remove a main feature you rely on, we'll tell you in advance where we reasonably can.
- We aim to keep FareLedger available, but it may sometimes be unavailable for maintenance or because of problems beyond our control (for example, an outage at a service provider or your internet connection).
- If we decide to close FareLedger, we'll give you at least 60 days' notice so you can download your records, and refund any unused part of a paid subscription.
9. Your rights under Australian Consumer Law
FareLedger comes with guarantees that cannot be excluded under the Australian Consumer Law (ACL), such as the guarantee that services are provided with due care and skill. Nothing in these terms excludes, restricts or changes those rights.
10. Limits on our responsibility
To the extent the law allows, and apart from your rights in section 9:
- FareLedger is a record-keeping and estimating tool. We are not responsible for tax, penalties, interest or other losses that come from figures you didn't check, records you didn't keep, or decisions you made using FareLedger.
- We're not responsible for losses caused by things outside our reasonable control, or by Uber, DiDi, Apple, Google or our service providers.
- We're not responsible for indirect losses, such as lost profits or lost opportunities.
- If we're responsible for a loss, our total liability to you is limited to the amount you paid us for FareLedger in the 12 months before the loss. Where the ACL lets us, our liability for failing to meet a consumer guarantee is limited to supplying the service again or paying the cost of having it supplied again.
11. Ending your account
- You can stop at any time. Delete your account in Account → Delete my account. This deletes your records and uploaded files, as explained in our Privacy Policy. Download your export first.
- We may suspend or close your account if you seriously or repeatedly break these terms, or if the law requires it. Unless it would be unlawful or unsafe, we'll tell you first and give you a chance to download your records.
- Deleting your account doesn't cancel your subscription. Cancel it in your Apple or Google account settings first, so you aren't charged again.
- If we close your account because you broke these terms, you won't get a refund for the rest of the current period, except where the law requires one.
- If we close your account for any other reason, or close FareLedger, you can ask Apple or Google for a refund of the unused part of your subscription, and we'll support your request.
12. Changes to these terms
We may update these terms, for example when we add features or the law changes. We'll update the date at the top. For important changes, we'll tell you in the app or by email at least 30 days before they apply. If you don't agree with the changes, you can stop using FareLedger and delete your account before they apply.
13. General
- These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales can hear any dispute.
- If you have a problem, please contact us first so we can try to fix it: support@fareledger.com.au.
- If part of these terms can't be enforced, the rest still applies.
- These terms and our Privacy Policy are the whole agreement between you and us about FareLedger.
